3. Membership, registration and payment of cashback. To become a member and participate in the internet cashback service you will need to register on this website. By registering as a member you confirm that you are over 18 and are resident in the UK. Membership is subject to the following additional terms and conditions. It is your responsibility to keep your user name and password confidential and that they are not used by any other person.

3.1, Membership. Each person may only have one membership account with internet cashback. We reserve the right to decline membership for any reason.

3.2, Membership termination. You are entitled to terminate your membership at any time. We will be entitled to terminate your membership without notice however, this will not affect any cashback you have earned or been awarded prior to termination, unless we have reason to believe that there have been fraudulent transactions.

3.3, Earning cashback. internet cashback members may earn cashback by shopping (online) with any one or more of the Retail Partners. Members must click onto the retail partner fromRetail Partners when going through to make a purchase to qualify for their cashback payments. 3.4, Refer a friend. Members that "refer a friend" will not be entitled to receive any cashback on the friend's joining bonus. Members will only earn cashback on their friend's cashback when he or she purchases a product or service from a Retail Partner through this website and we receive the cashback from the Retail Partner in cleared funds.

3.5, Payment conditions

(a) Each transaction you make is between you and the Retail Partner and any queries, complaints in relation to the transaction must be referred to the relevant Retail Partner and not internet cashback.

(b) Your internet cashback member's account will be credited when the Retail Partner confirms your transaction which could take up to 120 days to take into account the returns procedure of the retailer. Until your purchase has been confirmed to us by the Retail Partner, the cashback payment will be listed as pending.

(c) If a purchase is returned, refunded or a transaction is reversed, the cashback payment to you in respect of such will not be due to you and will not be made.

(d) All purchases are electronically monitored by the Retail Partners who each provide details of the purchases to internet cashback. internet cashback will try to ensure that the Retail Partners are correctly reporting cashback sales to us. We will have no liability to you if a Retail Partner, fails to do so, however, in the unlikely event this should occur, if you provide us with full details of the purchase (including the date and time it was made), we will contact the Retail Partner on your behalf and try and obtain the cashback for you but will have no liability to you if we are unable to do so.

3.6, Payment procedure

(a) internet cashback will only make payments to you after we have received the relevant monies in cleared funds from the Retail Partner. All payments will be made by cheque made payable to the payee registered on the member's account and sent by post to the address nominated on the member's account.

(b) No payment will be due and no payment will be made until the amount of cashback accrued by the member is at least £40. Once a cheque has been dispatched, the amount of the cheque will be deducted from the cashback member's account and further payment(s) will be made only when the cashback reaches £40.

3.7, Delivery of Payment

You will receive payment by the form of cheque, if your payment request is received between the 25th and 5th, it will be issued within 7 days from the 5th. If your request is received between the 5th and 25th, it will be issued 7 days from the date of your request. Please be aware you may only request payment once your 'available cashback' reaches £40.

4. Retail Partners. Our Retail Partners and other third parties may occasionally promote their goods or services on this website, through our email services and our newsletters. Whilst we try to encourage our partners to offer good quality products and services at competitive prices we have no control over them or other third parties, we do not endorse the products or services they offer or give you any assurance that they will be suitable for your needs. It is your responsibility to satisfy yourself in this regard and we have no liability in connection with the same. You acknowledge and accept that our Retail Partners will change from time to time and that this may affect the cashback opportunities available to you.

5. Ownership of materials and licence terms. This website and the materials on it or available through our email services are protected by copyright, trade mark and other intellectual property rights and laws throughout the world. The materials on this website are owned by or are licensed to us. You are permitted to display the materials on this website on a computer screen and to download and print a hard copy for your personal use provided you do not alter or remove any copyright, trade mark or other proprietary notices.

You agree not to:

(a) use any of the materials on this website for commercial exploitation without the our prior written consent;

(b) frame this website or establish a link to it or any part of it from any other website, intranet or extranet site without our prior written consent;

(d) or do anything that may infringe the rights of any other person.

If you send any comments, suggestions or materials to us from or concerning this website or our email services, any materials on or in either of them or relating to this website or our services you permit us to use them in any promotional literature in any form and media without further recourse to you. Internet transmissions are never completely private or secure and there is a risk, therefore, that any message or information you send to us from this website may be intercepted and potentially read by others. We will have no liability in respect of any transmissions you send to us and you do so entirely at your own risk.

13. Liability. OUR SOLE LIABILITY TO YOU IN RESPECT OF THIS WEBSITE AND THE INTERNET CASHBACK SERVICE (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE) WILL BE TO PAY CASHBACK THAT HAS BEEN EARNED AND IS PAYABLE TO YOU AS SET OUT IN THESE TERMS AND CONDITIONS.

NOTHING IN THESE TERMS AND CONDITIONS EXCLUDES OR LIMITS OUR LIABILITY FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.

14. Refer a friend and information relating to a third party. You undertake not to either include or otherwise disclose any confidential information or personal data relating to third parties in connection with your use of the website without that third party's express consent. By participating in our "Refer a friend" service the information we send to your friend will be at your request and on your behalf.

15. Variation. We reserve the right to change these Terms & Conditions at any time. The new version will be posted on this website and will take effect immediately upon posting. If you use the website after the new Terms & Conditions have come into effect any further use of the website indicates your agreement to be bound by the new Terms & Conditions.

16. Assignment. These Terms & Conditions are personal to you and you are not entitled to transfer the whole or any part of them to any other person. We are entitled to transfer our rights and/or obligations under these Terms & Conditions at any time.

17.Third party rights. Nothing in these Terms & Conditions is intended to confer a benefit on any third party under the Contracts (Rights of Third Parties) Act 1999 which will not apply.

18. Governing law. These Terms & Conditions are subject to English law and each of us hereby submits to the non-exclusive jurisdiction of the English courts save that we will be entitled to commence and/or defend proceedings in any territory to protect our intellectual property rights or confidential information in that territory.
